The Department of Justice ( DHS ) said President Donald Trump’s government can implement policies that allow immigrants to be deported quickly, without the need for a court hearing.
In 2019, the Immigration and Customs Enforcement ( ICE ) office announced its plan to expel immigrants from the country who did not prove that they have lived in the country for more than two years in any entity far from the border.
Currently, ICE can expeditiously deport immigrants who are within 100 miles of the border.
Last September, in a 126-page ruling, District Court Judge Ketanji Brown Jackson stopped the policy change, stating that the Trump Administration’s decision-making process that led to the change seemed to have violated federal law, in addition to criticizing officials for not carrying out a formal notification and comment practice required for major changes in federal regulations
The portal Law360 reported that the federal government asked the DC Circuit of Appeals for permission to implement this measure.
“It would allow the government to deport more people faster, saying that DHS has full discretion on such immigration decisions,” the report said.
It added that DHS has the authority to implement these policies, supported by the Immigration and Nationality Law (INA), combined with the fact that the judge “lacked authority” to suspend this policy.
Another justification of the immigration agency is that the policy would ease the burdens in immigration courts, in addition to freeing room for beds in immigrant detention centers.
Several organizations for the defense of immigrants and civil rights, such as the American Civil Liberties Union ( ACLU ) and the American Immigration Council seek to stop the measure.

El Departamento de Justicia (DHS) afirmó que el gobierno del presidente Donald Trump puede implementar políticas que permita deportar a inmigrantes en forma exprés, sin necesidad de una audiencia en corte.
En 2019, la oficina de Inmigración y Control de Aduanas (ICE) dio a conocer su plan para expulsar del país a inmigrantes que no demostraran que llevan viviendo en el país más de dos años en cualquier entidad lejos de la frontera.
Actualmente ‘La Migra’ puede deportar en forma expedita a inmigrantes que se encuentran a menos de 100 millas de la frontera.
En septiembre pasado, en un fallo de 126 páginas, la jueza de la Corte de Distrito, Ketanji Brown Jackson, detuvo el cambio de política, declarando que el proceso de toma de decisiones de la Administración Trump que condujo al cambio parecía haber violado la ley federal, además de criticar a los funcionarios por no llevar a cabo una práctica formal de notificación y comentarios requerida para cambios importantes en las normas federales.
El portal Law360 reportó que el Gobierno federal pidió al Circuito de Apelaciones de D.C. permiso para implementar su medida.
“Permitiría al gobierno deportar a más personas más rápido, diciendo que el DHS tiene un dictamen total sobre tales decisiones de inmigración”, indica el reporte.
Agregó que el DHS tiene autoridad para implementar estas políticas, sustentadas en la Ley de Inmigración y Nacionalidad (INA), aunado a que la jueza “carecía de autoridad” para suspender su política.
Otra de las justificaciones de las autoridades migratorias es que la política aliviaría las cargas en los tribunales de inmigración, además de liberar espacio para camas en los centros de detención de inmigrantes.
Varias organizaciones de defensa de inmigrantes y derechos civiles, como la Unión Americana de Libertades Civiles (ACLU) y el American Immigration Council buscan detener la medida.
